LATE KISS DRUMMER ERIC CARR’S ROYALTY SUIT FILED WITHOUT KNOWLEDGE AND PERMISSION FROM HIS FAMILY

ericcarr430 The lawsuit filed against Kiss in respect of royalties allegedly unpaid to Eric Carr was filed without the support or knowledge of the late drummer’s heirs.

They’ve instructed the lawyer who launched the legal action to cease and desist and KISS frontman Paul Stanley tweeted, “Eric Carr’s family is shocked by a lawsuit filed without their knowledge or support. We will deal with this attempted scam appropriately.”

According to an article in the New York Post, attorney Robert Garson reported that he’d initiated the lawsuit on behalf of an unnamed friend and an unnamed relative of Carr, who died in 1991, because it had been discovered money was sure from overseas sales of his songs.

However, Mark Abbattista, representing Carr’s family, tells blabbermouth, “This proceeding was filed by a non-related third party without any knowledge, authorisation or consent. The party’s attorney has been contacted and ordered to cease and desist from any further statements, actions or allusions purporting to be on behalf of Eric Carr and/or the Carr family.”

He adds that Stanley and bandmate Gene Simmons are aware of the situation and continues, “it is imperative to set the record straight and let the fans know that we are unified in our response to preserve and protect the honourable and beloved legacy of Eric Carr.”

A family member commented, “We’ve known each other for 35 years and we have the highest respect for Kiss and keeping Eric’s memory in a positive light.”

    1. There are so many versions and rumors and assumptions as to what actually happened at the time of Eric’s death. Unless you have some “inside information” or were you actually present in the room with Paul, Gene, and Eric when everything went down in 1991, I don’t know how you can comment as if you know. Based on yesterday’s statements by the Caravello family attorney and Eric’s sister, it sounds as if they are all on united and good terms…

    5. Maybe everyone should just read the entire story and then find out that even Eric’s family have nothing to do with this suit. They’re the most important people in this saga.

    6. When was Eric fired? It was insisted that Eric focus on his health and recovery so that he COULD rejoin the band. Eric Singer was brought in only as a session drummer during this time. If and when Carr recovered, it was always intended that he take his rightful place behind the drum kit.

Im not sure if they “fired” him or just convinced him that his health was first priority over the band…that being said, I did hear a rumor that P/G did show up @ the hospital and told him he was out of the band and they also dropped his health insurance…I asked Bruce about this and he had no knowledge or recollection about that…the bottom line: Eric Carr came along at a crucial time and gave kiss a kick in the ass when they so desperately needed it..RIP the FOX!

  2. In other words Gene & Paul told the estate: get the ice out, our Century City Wilshire Boulevard team of lawyers will pound you….here’s a token amount, take it or your lawyer eats 40% of a settlement. This stuff is usually behind doors but I guess Gene & Paul’s amount originally was a joke.

  3. They didn’t fire him…if they had the family would not be united and aligned with the band. As for the insurance, that’s something that’s come up from time to time from Bill Aucoin and others. And frankly that would not be surprising if you know anything about insurance and a private small business which Kiss was at the time. The band/the business certainly wasn’t rolling in the dough at the time. I would say they probably did remove Eric from the bands policy as it would have had the potential to bankrupt the band at that time… and worked out a private deal with the family in some form or fashion to handle the medical expenses. Had they not…this would have gotten out a long time ago and again, the family wouldn’t be united and aligned with the band. The statement from the family basically curtails all rumors of Eric’s firing from the band.
